By accessing or using Qlipsy.ai ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Qlipsy.ai is an AI-powered video generation platform that automatically creates, edits, and publishes short-form videos for social media platforms. Our Service includes:

  • AI-generated video scripts using OpenAI
  • AI-generated images using Runware
  • Text-to-speech conversion using ElevenLabs
  • Automated video compilation and editing
  • Scheduled publishing to connected platforms (YouTube, etc.)

3. User Accounts

3.1 Account Creation

You must create an account to use our Service. You agree to provide accurate, current, and complete information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

3.3 Age Requirement

You must be at least 18 years old to use this Service.

4. Subscription Plans and Billing

4.1 Plans

We offer subscription-based plans with different features and video generation limits. Current plans include:

  • Starter Plan: 3 videos per week (12 videos/month)
  • Pro Plan: 1 video per day (30 videos/month)

4.2 Billing

  • Subscriptions are billed monthly in advance
  • Payments are processed through Polar (our payment processor)
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice

4.3 Edit Credits

  • Script edits are always free and unlimited
  • Image regeneration costs 1 credit per image
  • Credits are included with your plan and do not roll over

4.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds for partial months.

5. Acceptable Use

5.1 Permitted Use

You may use the Service to create videos for lawful purposes consistent with these Terms.

5.2 Prohibited Activities

You agree NOT to:

  • Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful
  • Violate intellectual property rights of others
  • Create misleading, deceptive, or fraudulent content
  • Generate spam or unsolicited promotional content
  • Create adult content or content involving minors
  • Impersonate any person or entity
  • Attempt to reverse engineer, hack, or interfere with the Service
  • Use the Service to train competing AI models
  • Resell or redistribute generated content as a service
  • Exceed rate limits or abuse the Service

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you provide (topics, scripts, etc.). By using the Service, you grant us a license to use, process, and store your content to provide the Service.

6.2 Generated Content

Videos generated by our Service are yours to use commercially. However, you acknowledge that:

  • AI-generated content may not be eligible for copyright in some jurisdictions
  • Similar content may be generated for other users
  • You are responsible for ensuring generated content complies with platform policies where you publish

6.3 Our Intellectual Property

The Service, including its software, algorithms, design, and branding, is owned by Qlipsy.ai and protected by intellectual property laws.

7. Third-Party Platforms

When you connect third-party platforms (YouTube, etc.):

  • You authorize us to publish content on your behalf
  • You must comply with each platform's terms of service
  • We are not responsible for actions taken by third-party platforms
  • You can disconnect platforms at any time

8. Service Availability and Limitations

8.1 Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may suspend the Service for maintenance or updates.

8.2 Video Generation Time

Most videos are generated within 5-10 minutes, but times may vary based on length, complexity, and system load.

8.3 Content Moderation

We reserve the right to review, modify, or remove content that violates these Terms or applicable laws.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • The accuracy, quality, or appropriateness of AI-generated content
  • That generated content will achieve specific results or engagement
  • That the Service will be error-free or uninterrupted
  • That third-party platforms will accept or promote your content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QLIPSY.AI SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Actions taken by third-party platforms
  • Content generated by AI that violates third-party rights

Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Qlipsy.ai from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Content you generate or publish

12. Termination

12.1 By You

You may terminate your account at any time by canceling your subscription.

12.2 By Us

We may suspend or terminate your account if you violate these Terms or for any reason with notice.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your data after 90 days.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law
